New Florida Gun Law Allows Wide-Ranging Self Defense

A bill permitting the use of deadly force during a home invasion or when an individual considers themselves threatened unanimously passed the Florida Senate on Wednesday.

The measure (SB 436) would eliminate criminal penalties for an individual who uses deadly force as self-protection in his home or vehicle and other unspecified circumstances.

The Senate passed the gun measure, supported by the National Rifle Association, on a 38-0 vote just moments after it defeated a proposal that might have cleared the way for Terri Schiavo's feeding tube to be reinserted.
The open-ended language on the bill sponsored by Sen. Durell Peaden Jr. concerned some lawmakers.

"Under the wording of this bill, somebody could go onto any of the streets and if they think somebody is walking toward them in a threatening fashion, they can pull out a gun and begin blasting away," said Sen. Steven Geller, D-Hallandale Beach, who sought unsuccessfully to amend the bill on Tuesday.

"We're heading towards a Wild West mentality," Geller said. "I am concerned that you could literally have two guys standing on the street, both of them ready, the guns at their side, and then say 'Well the other guy threatened me so I pulled a gun and shot him in self defense.'"

Peaden, R-Crestview, scoffed at the characterization.

"You have to be within the confines of the dwelling as described in this bill," Peaden said during Wednesday's floor debate. "You just can't shoot anybody on the street and drag 'em in."

Geller said he voted for the bill for political reasons.

"We'd be seen as Democrats soft on crime," he said.

A similar proposal (HB 249) was approved on an 8-2 vote Wednesday by the House Justice Council.

Sadly, this is actually a little watered down. Don't get me wrong, it's still a good law - but the original provided legal protection against any obligation to retreat when a "person is in a place they have a right to be." A little broader than the final version. The most important part though, remained intact - protection from civil liability. If it's a "good shoot" the shot party or their family can't sue in civil court - and if they do and lose, all legal bills fall to them. :up:

Florida is definitely on the leading edge when it comes to gun rights. If it wasn't for the constant darn heat, we would have stayed there.

John, after spending six years down there, I happy to be back in the north-east where there's snow in the winter. It might sound nice to have temps in the 80s when everybody is freezing & shoveling snow but in the Spring & Fall, the temps go even higher and the summer is especially brutal. When you experience a couple years of this with no break in the heat wave, you start to dread it and begin to long for colder weather.

I'm willing to give that a try, Alan.
As time goes by the frost-bite damage in my hands becomes more and more sensitive to cold, and the pain becomes more severe .... without gloves I can tolerate +/- 15 minutes at, or below, 40 F.
When the temp. drops below 20 F I've got, maybe, 10 minutes .... no matter what I'm wearing for gloves.

Gainesville would be good. As would anywhere north of it. Still gets cool in the winter, but nowhere near "bone-chilling" cold. Here in Jacksonville I think our coldest this last season was around 30 - and it never stays that way long.

Yea, that's what I've been thinking, more temperate climate, horses are a "normal" hobby .... now all I've got to do is convince CCB that is would be a good idea.
